if you read into it from link above you will find what action if any the police can take in regards to what happened..

Yes and no. the Police can always resort to persecution where prosecution is unavailable to them.
The link you refer to has a copyright date of 2002, so is now 3 years out of date, and it refers to the Sex Offences Act which was being planned at the time, and which was finally passed in a very modified form in 2004. It's too late to do my research to put a full answer together now, but I promise a fuller one tomorrow evening. But it ain't all as bad as it seems, and you will note that even in this linked page, the Police have to prove to the jury, that a flasher (etc) has "intended to cause alarm or distress". Not so easy for them to do I suspect.
Anyway, it's bed time....later folks...
hi there party man, look forward to any more info you may have....
thanks , i am sure the rest of us on here will all benefit from you knowledge
good one wink
If it wasnt for all the idiots, boy racers, police officers with nothing better to do and local busy bodies then BB might return to a fantastic site for dogging meets that is full of genuine people who have manners, can be polite and dont spoil the fun.
i agree, it would be a great place to meet really nice gents like yourself nottsguy2
cool wink
hi, i posted this with a genuine enquiry , i have never been dogging and would love to go there as i live local. i am sorry if i have caused a stir among the regulars that use it, i have no intention of upseting anyone redface
well all i can say is the fact some people sit around drinking tea and talking at this site is because they are players and do have lots of fun thats why they are so relaxed hence the popularity of the place .
but with all the goings on of late we will not be out again for a long long time so sorry guys. sad

Hard4u,
Go and give it a try long as you show you are a polite and considerate dogger you will have plenty of fun. Act like an arse though and plenty of people will soon tell you to f*** off!!
:laughabove: i for one agree with that. k.
Just wish we could get rid of all the boy racers and gangs too, make people feel much safer.
Would love to put a brick through their windows but then I would get arrested for criminal damage....hmmm where is the justice in the world????

OK, well firstly, I'm no lawyer, so please don't hang your hats on this, but the legal training that I had as part of my other professional studies, taught me how to look at how laws are written and how to derive their meanings. You can see what it says for yourselves here and make your own minds up -
You will see that sections 66, 67, & 68 are the ones relevant here.
Section 66 is almost plain English. Pull your bits out, IN ORDER TO OFFEND and you will be busted for it. We all know that in Dogging, that's not the intention, and without the intention, there is no offence under this section.
The original draft of this act was much stricter than this and would have criminalised nude sunbathing and emptying of bladders behind trees. Thankfully some common sense was applied before the final version of the wording was published.
Section 67 (1) - if you get your kicks out of creeping up on courting couples, and the courting couple don't kick your ass when you get caught for it, then the law will kick your ass for them.
Section 67 (2 & 3) - The aspiring Dudley Moore's of the world with telescopes trained on bedrooms had better watch out. Anyone with a camera being used in secret whilst dogging had better watch out too. Doggers allowing other doggers to secretly film / photograph a "showing" couple without the couples consent, could also be done for aiding and abetting.
Section 67 (4) - Doggers Dens sound like being the target here. You are not in a den if in your own car though, as you won't have constructed it yourself UNLESS you modify your vehicle to assist your "dogging experience".
Section 68 - this clarifies what is meant by a sexual act, and is pretty straight forward.
So, dogging as we know it, which is done between knowiing and consenting adults, who get a thrill (as opposed to offence) out of what they are doing, and who do not indulge in the fringe activities are OK. The Police will do their utmost to use the Act to scare you, relying on doggers wanting an easy life without hassles to get their way.
My own experience of the Police in the year since the Act was passed, is that the Police know that the act is a toothless tiger when it comes to dogging, and they try more subtle scare tactics of warning of Criminals in our midsts.
Admittedly, so far there has not been any case law to back up any particular interpretation, but it is my belief (and feel free to disagree) that no offence is being committed by 99% of all doggers / couples.
Do beware though, of guys who you suspect of "forcing a female" to perform. If she squeels, and claims offence by your finger exercises, you could be in deep pooh. And as said, if anyone thinks that they are the invisible man and can sneak up on the "innocent" courting couples, they to are endagering their own liberty and also the future of their car park.
Oh, one last thing, the wording mentions the penalties for being caught. What it doesn't say, is that ANY offence under this Act, gets you a free entry into the Sex Offenders Register as well.
Hope that this helps.
Good breakdown of the law but surely they can pull out the charge of indecent exposure. Wasnt there a case recently where by a couple got charged for having sex in their own house but they could be seen through the window. Not sure what charges applied on this but shows if they can prosecute you for having consenting sex in your own home they can prosecute you anywhere.

There's lots of folk lore and wive's tales on this subject, and originally the draft legistlation served to stoke it all up, with wordings about "being in a position where you can expect to be seen", but these wordings were dropped from the final version.
That said, I am not a lawyer, so I don't make a living out of following all the landmark cases that go to court. I can't believe that there are no lawyers who are members of this forum, so I would yield to a more professional opinion and knowledge.
I am sure there are lawyers and a few of our boys in blue friends who are members of this site who could clarify things for us.
Come on boys stop hiding we are looking to you for your professsional knowledge in this subject.
Hi, we are thinking of going out tonight and used to go to bb but dont think we should for a while till it quietens down. Anybody know of any good places in the area or quiet places for meets. Looking for couples with bi-fem or w/e young men. Reply with pm,s please. cheers K.
Oh for the good old days of Blidworth befor Chanel 4 put it firmly on the map. My then partner and I used to go up 2 or 3 times a month and met some great people and had some good fun.
The end came for us when a crowd of 5 blokes got nasty cos we wouldn't show and scratched my new car (try explaining that one to Norwich Union).
Hopefuly the cruisers will soon realise they are backing a looser and go off into the sunset.
In the mean time I hope things do improve there as I would love to go back.
(Exposure
(1) A person commits an offence if-
(a) he intentionally exposes his genitals, and
(b) he intends that someone will see them and be caused alarm or distress.
(2) A person guilty of an offence under this section is liable-
(a) on summary conviction, to imprisonment for a term not exceeding 6 months or a fine not exceeding the statutory maximum or both;
(b) on conviction on indictment, to imprisonment for a term not exceeding 2 years.)
Having Read the relevant sections in the act does it mean that a couple going out and putting on a show are not commiting an offence unless it is seen by someone who did not intend to watch in the first place? Surely if you are in a car park miles from anywhere at midnight with people that are there for the same reason as you the law would be unable to act?
Would be interested in others views on this one!
See my other post, they are calling it ASD and indecent exposure!!!!
I'm trying to find out more, but maybe the boffins can define these terms for us as well..

Remember the old kiddies story about huffing and puffing and not being able to blow the house down???
The Police will play on the fact that they are in Authority, and that their knowledge of the law is supposed to be greater than yours. They also rely on you as an individual / couple not wanting to argue for fear of spending the night in the cells while they decide not to press any charges. So they will blind you with science, and unless you are courting trouble, you will usually end up going home.
But to prosecuted with indecent exposure, they have to literally catch you with your bits out, AND show to the courts, WHY the exposure was indecent. I had a look here - and here
If you read the articles (esp the last paragraph of Aunty Beeb's page) you will see that very often there is no legal basis for the Police's actions. My guess is that some yourng Police Constables get their kicks out of a "power trip" as much as we get our kicks out of dogging. Don't think that will ever change
Just wondered if anyone is out tonite??
Havent been out this weekend so just wondered if much has been going on and the level of police activity.
PM me to let me know.
