compensation claims- any advice?

Hi guys,
this was the first place I thought of to get some truly impartial advice.
My beloved classic Mini was written off the other night with me & my 12 year old in it. Briefly, we stopped at a junction with a main road, and the git behind in his big BMW decided he was going for the gap & assumed we'd gone.
He accelerated hard into the back of us, pushing us into the oncoming traffic, which thank christ didnt hit us.
The mini's a write off, and we both have whiplash.
I dont want to fallprey to the "ambulance chasing " vultures, but he's fully comp andhis company have admitted liability so im thinking we are in genuine pain so what the hell.
Has anyone had experience of this kind of thing & can you give me any tips?

Cant help on the claim but you have my sympathy. Ive had my 1980 1275gt from new until last year some local hoodlums kicked in every panel
Ive bought a new shell to restore mine given the value of shells you might consider that

Write a diary of everything, starting with the accident and putting down every twinge, taxi fair, telephone call and peice of paper you use. You should get reimbursed for all of you suffering and all of your costs incurred because of this moron.

It is worth noting that once an individual makes a personal injury claim they may have difficulty in getting future insurance cover for health/life etc
My first tip if you are in pain is to get checked out by the doctor so that this is noted on your medical records and aslo to make sure that there is going to be long term dmage.
If you are going to claim compensation contact your insurance who will put you in touch with a solicitor that they would recomend these usually know what they are doing better.
You will be asked after a period of 2 months to go to see a specialist who will note down all the facts of the injury and make a report.
The other insurance will make an offer based on that report, your solicitor will tell you if the offer is ok to accept.
But also make a note of all your out of pocket expenses.

Years ago I got knocked off my push bike by some nutter trying to overtake me.
As Marmaliad says keep a check of everything it may be you are ok and then something else happens.
Sue for everything if he's got the insurance take him for everything
I got just over 200 quid and a new bike that was 20 years ago
find a good loss assessor on the case, if they are good, you should not have to pay out of your own pocket, as they will put about 10% ontop of your claim for expensies, so the insurance will deal with.
Once you have seen your doctor and your injuries are noted, there is no rush. You have 3 years to make your claim. However, what these people are failing to tell you is... if you rush ahead and let it be known you wish to make a claim now.. the Wolfe Report (published in 1990-something) states that the other party (or thier insurers) have a duty to meet timetable to avoid delays and like wise your insurers/solicitor will need to get a move on too. The result is you get paid on anticipated duration rather than actual.
Now if there is next to f-all wrong and you are just a bit sore - go for it now.
If there is a chance there could be longer-term problems (which is hard to predict) then you will likely shoot yourself in the foot by rushing ahead now.

There is no doubt there will be a payout - but there is a price. Once it is noted that you have successfully made a personal injury claim it effects your own personal insurance in the future - anything relaiting to life/health.
that is correct about not rushing but the insurance will send you to see a specialist who will asses you and write a report.
If you have not recovered by the time he sees you he will send you for other investigation etc and see in another few months.

Not correct.
The Wolfe Report came about to stop the delays. Though it was because the paying-out party used to drag their feet asking for all sorts of reports and holding out hoping the claimant would get tired or run out of finances to remain off of work etc.
The whole idea of the timetable is to prevent additional hardship (financial) by speeding up the payout process.
I was the rear passenger in a Crash in Feburary
The Driver and front passenger claimed straight away
I had to follow suit

Have just been back to my gp, referred to physio because of the lack of mobility in my right shoulder. This was caused by how hard I wrenched on the steering wheel to stop us going into the path of oncoming traffic on the other side of the main road- my left arm instinctively went over my daughter to push her back.

Its several years since I worked in insurance, but from what I can remember whiplash claims should be made through you car insurer not a seperate personal injury specialist. Claiming this way will also mean that you are only having a single claim processed (written off car and injuries together - Your daughter should also be able to claim through your car insurance as a passanger) This means that when you are asked about any claims you have made in the last X number of years for future insurance policies you will only have the one claim.
The Claims Clerk of your car insurance company should be available to answer any questions you have and advise on the best course of action.

See your doctor ASAP,
Don't get involved with the accident ambulance chaser firm Phone around some solicitors and find one who specialises in motor accident/ personal injuries (if you really can't find out, your local Citizens Advice bureau will tell you) and who will give you a free initial interview to check the likelyhood of having a successful claim.
Hope your sufferring is alleviated by any compensation obtained.
