Yes it is illegal of it causes, or is intended to cause; fear, emotional pain or humiliation. If this happened while at school - the person who 'stole' the vid can be dealt with via the school. It should be no problem to get YouTube to delete it.
Whether it's worth pursuing is up to you. Maybe rising above it is the best revenge?

Im so sorry to hear of this upset for you and your family.
I would report it to the site hosts, explain what has happened and ask them to remove the video.
I think you should act to show your son that he has your total support. Very important at such an age.

My daughter has been a victim of cyber bullying I think parents should take so much care in knowing what sites your children use and who they are talking too.
I knew my daughter had msn and I have kept a close eye on who she talks to and accepts onto her contact list. I also have her name on my msn so I can see when she is online but have it blocked my end so she doesn’t see me. A few times she has signed in when I know she has no way of being online as she has been out with family.
I have since found out she had given her friend her log in details and this friend posing as my daughter (who is just 12) has been saying sexual things to boys at school who my daughter has on her contact list.
I feel with a lot of chat sites children think they know what they are doing but some have the innocence of not totally understanding this media.
I have taught my children safe internet use, but the whole internet is to complex for them to totally understand the dangers too.
I have also found out unknown to me she had set up a face book profile with all her details. I have decided to ban my children from chatting online until they are 16+ and have deleted all their accounts
If they need to chat with friends I bought a mobile with a £20 a month contract with 3000 roll over minutes, they can use that to chat instead.

I would urge anyone who has children to check it out and then to show their children the site. It has different sections aimed at varying ages and aims to inform children about online safety.
It is run by the Child Exploitation and Online Protection unit of the police.
The issues about giving out log in details and not knowing how to report things that happen online etc are such common problems.
I know it perhaps doesn't address the original post, but I feel very strongly it is a valuable site for parents and children to be aware of.

p.s. Mrs B, hope things are okay for your son and, as others have said, I would get You Tube to remove the video. If he knows who has posted the video - or likely suspects - then I would probably contact school too.
