Noisy Neighbours :(

Does anyone know the laws about noisy neighbours please?
I went to Steveg's last night to the Ann Summers party (anyone interested in attending the next one see here) and after drinking rather more vodka than I intended (including some of Steve's which I blatantly stole redface) and not arriving home until approx 4am, I'm feeling extremely tired and the worse for wear tonight.
I managed to keep myself awake when I was practically dead on my feet at tea time, fed my children and watched some telly so that I could have a nice early night.
Chance would be a fine thing!!!!! mad :x :x
I live in a terraced house, and attached on one side is a pub/social club. Obviously it was there when I bought the house but I was told that there wasn't much noise from it. I :censored: wish!
My "early night" has been stolen from me because when I went to bed it actually sounded as though there was a crowd of people in my bedroom. I can hear practically every word and trying to sleep in those circumstances is totally futile.
Many of you will know that I am something of a night owl so this isn't usually a problem to me (I'm often on the forum til 1am anyway) but when I want an early night it's just impossible!
What can I do?????
And as an afterthought, its (for those who don't have their SH clocks set correctly lol)
Aren't pub licencing hours shorter on a Sunday?? I thought last orders finished at and everyone was supposed to be out by I know there's some flexibility with this, but I can still hear quite a few voices.
Even worse, if I go to bed now, there's a chance I may get to sleep........... Only to be woken when the taxi drivers knock on the pub window. Being a terraced house it sounds as though they're knocking on MY window

I discovered that I am suffering from "Neighbourhood Noise" but when I went to the NSCA website I tried to find out what to do about it and got stuck in a loop
I'll try again tomorrow - assuming I get some sleep tonight!
You need to contact your local enviromental health dept. They will have officers who will come around and monitor the situation. The perpetuators of the noise will be warned of the nusiance they have caused and be told to stop. If they do not they will be given a formal warning. If things persist beyond this they will be taken to court.
If it is a pub causing the problem they will have their licence removed if they do not solve this problem. Sounds like they are breaking the rules of licencing to me and having a lock in. You could call the police to check it out! There are rules concering pubs and the local council who issues licences takes these problems into account.
These things can take time to resolve. Any more problems with the pub, get the police involved. That should move the troublemakers on.

Just remember to turn your pc off when your local enviromental health dept.
As it can cause quit a shock to then seeking swinging heaven on the screen of your pc!!

Foam earplugs, which you can buy from Boots or most any chemists. Earfit work best, in my experience - cuts out noise almost completely, and it's not difficult to sleep with them in. Noise has been the bane of my life, and believe me, earplugs have saved my sanity many a time.

Angel,we had the same problem a few years ago with noisy neighbours,
Love Commando was right about getting in touch with the enviromental health dept,they have a day time number and an "emergency number",the emergency one is to be used to call them when the noise is happening for immediate action.
Luckily we were moving house and didn't have to take it much further,but after a few letters to the neighbours from the environmental health it did calm down.
You also need to document any contact between you and them,ie;if you asked them to be more quiet etc.
The next step after that is that they install equipment into your property to gauge the level of sound and to see if it is a breach of the peace,then on to court if it persists.
As is it a pub that your having a problem with it might be worth consulting a lawyer on the legalities on staying open now they have changed the laws over closing times.
It may have been a party and a one off last night,but again as Love commando said if it is a case of illeagal lock ins then contact the police.

Clare is quite correct in the way things are delt with by environmental health.
I've had a lot of problems with neighbors where I live over the years. Sometimes they are not aware of the problems they are causing and a polite reminder is all that it takes. All to often though you get someone who dosen't give a f**k for neighbourly relations and so that's the point where you contact your council dept. Though it can take months to get things sorted if the neighgbiours persist. Usually just a letter from the council does the trick.
If it's a pub that's causing the problem then is will be easier to deal with as they have to abide by rules of licencing. They may be having lockins with their mates but if they had any sense they would keep the noise down. Licencing laws have changed but they may not have an extended licence and anyway I should imagine these are open to review. If there is a problem with the pub then I'm sure the police won't mind dealing with this as it's fairly rountine stuff.

Its not really a pub, more of a social "members only" club. The place is only the same size as my house but they have quite a lot of members from what I can tell. Its midnight now and they're still in there having several rather animated conversations. I did go round once to complain because they'd made so much noise (the cue ball had got stuck so they bashed the pool table on the floor to free it - I thought my house was falling down!) but got so much abuse from the customers I really don't want to do that again.
I managed to get a couple of hours sleep earlier but I'm sooooooooo tired now.
AND!!!!!!!!!!!!!!! I just looked again at my clock. Tiredness doesn't agree with me because it's actually 1am, not midnight.
Yeah well whatever they are doing it is bang out of order.
Just contact your enviromnetal health dept as soon as possible. They will come out and monitior the situation and take the steps already outlined. They won't tell the clubs owners who complained. I'll bet others near by are just as pissed off as you but people feel afraid to complain and put up with shit until it's too late and they suffer unduly.
As regards it being a social club - well they may have to have permission to be a club from the council. You can't just open a social club - there are regulations such a fire regulations and planning regs. Do they sell alchohol? If they do they have to have a licence for that.
You may wish to seek further advice on this from CAB or from your local council office. Best contact the Enviromental people, they will be able to tell you straight away what action they can take, they deal with these situations all the time.

I was going to suggest having a word with the owner/landlord... as you got so much abuse you have 2 options... a word with the owner when the place is vacant of others, then if nothing its time to ring the police, especially if they are having after hours.
If you dont want to try the friendly approach, then ring the police... as its a "club" they have to abide by rules far more than just normal neibours... a knock by the boys in blue will shut them up very quickly, and far better than the council as they can act immediatly and the owner is not going to want to risk his licence.
After hours is usualy ignored by the police unless there has been complaints, if anything the police prefer one or two pubs to have lockins as it helps ease the mass bundle on to the streets at 10:55 and 11:20 just as long as it doesnt effect the local residents.
Angel you can borrow my earplugs if you want, i always have some handy when i come to visit wink
Thanks for all your replies. I'm bleary eyed yet again this morning and am definitely going to ring the environmental people even if just to find out what they would do.
The place has been a social club for years and years, possibly 50 or more and they definitely have a licence. I have met the club secretary and even went to a party that he and his wife held at their home a couple of years ago. If I can remember which house they live in (it was New Years eve and I got kidnapped as I was putting my key in my door coming home from another pub) I may drop a note into them to see if they can have a word.
I do get on pretty well with the guy who usually works behind the bar there, so if he's there when I get home from work today as he was yesterday I'll go in and speak to him as well.
I'll keep you informed as to how I get on. Hope I don't fall asleep at my desk today :crazy: :yawn:
(And thanks for the offer of earplugs Se7, I found one on my bedroom floor yesterday, any idea where the other one is? :shock: :shock: )
