Hi there i have a little problem which, i hope some of you can help me with.
On the street where i live (which is a terraced row of houses) there are a few tree's on a UNMADE & UNCLAIMED backstreet which some of us have cut down on one side of my house, as we want to make it a little nicer to sit out on in summer, you know maybe have a neighbourly BBQ on or something :cheers: and on the other side there is a large silver birch that adjoins mine and the house on the other side of me which we want to either cut back or if we can cut totally down, this tree is well over 10 feet tall, and it is starting to move some of the flag stones in my back yard :crazy: .
Now here is my problem the neighbour whom shares the silver birch has complained that we are acting out of order, for cutting down the trees and as some of my neighbours have already cut SOME of the branches off the silver birch, so it does let in light to there houses, and that on monday morning he will go to the local council to see if there is anything he can do about us either cutting down or cutting back the silver birch tree and us cutting down the other tree's.
Now my grind with him is this a few years back he said nothing to a few of the neighbours cutting back said trees, and the grass that was up to your waist in height rolleyes
So i was wondering can he do anything legally???
Please help as i need to know as i may not be able to sleep over the weekend worrying about this.

The trees may be protected, or they may not.
I'd get on to your local council pronto, before any more are cut.
Your neighbour probably won't be able to do anything because it isn't even his tree - I would have thought it was up to the owners of the land to complain, if anyone. As far as I'm aware (please, anyone, correct me if I'm wrong), you can cut off the offending branches as long as you give them back to the owner of the tree. So you should throw them back over the wall/fence. If it's causing problems because of the roots (lifting your flagstones) then you might be able to get the council or the owner to actually remove it. If the council come out for a look, ask them about that because of damage to your property.
get your local environmental officer to make a site vist and ask if there's a preservation order on the tree, and, make him/her aware of the damage the root system is doing to your property.

I wouldn't think there will be a preservation order on it, silver birch are common aren't they?

Legally you can cut back any branches that overhang on your property. but only as far as your property extends

You want to cut the trees DOWN to make the place nicer???? Sorry if I have misread this Mollman, but I think a small paving stone being lifted is well worth the price of having a bit of nature in what is obviously an urban landscape.
And if you say it is 10 feet tall.... exactly how harmful is that? Live with it, and appreciate the wildlife it brings into the area as well as the shade it may cast on hot days while you are having that BBQ...
I bought a 15 foot tall tree a couple of years ago, it lives in a (very large) container in my back yard. It has brought a bit of nature into the terraced, concreted street where i live, along with blackbirds and blue tits that previously hadn't been seen here.
I'm off to hug my tree now....

Yes thats right, any branches which are overhanging onto your property you can cust down but you MUST give (or at least offer them) back to the legal owner. Branches which are not overhanging on to your property must not be cut back or the legal owner of the tree may have a case against you for damage to his/her tree.

Hi just a little update here, nothing has been said or done as far as i know at the moment and, according to both the neighbours across the back and on the right of me, the neighbours to the left have not been down to the local council as my nieghbours to the right ( if you are finding this confusing then how do you think i feel :crazy: ) have been told by some of the other people on my street........ i suppose this is what you get for living in the back of beyond of lancs dunno anyway at the moment nothing is happening here, just thought i would keep you all up dated........... like i said before i will keep everyone posted SHOULD anything happen

I'm sure the street is a nicer place for having trees in it, and they shouldnt be got rid of. Silver birch are beautiful trees too. There are not nearly enough trees around where I live apart from conifers and would love to be able to see one of those on my street.
Andy i agree with what you are saying mate, but, you have to remember that these trees are begining to take over the backstreet and we want to make the unmade back street a little more better. As up until the local neighbour hood watch had " end gates " put up at the bottom of the street, with it being over grown other people were dumping there compost and other such things on it and it has become a right mess...... due to the people who had both my house and the house to the right of me not giving a toss about the backstreet.
So it has become like a mine feild with broken paving flags, used soil and we used to find empty cans of beer, not mine i hasten to add redface ( mind you the were pretty tidy people, they put the empty cans in plastic bags and tied them up and left them by the gates of different houses along the street dunno for people to put in their bins ) and the grass was almost up to knee height like i said earlier and i could not cut it back due to me suffering from hayfever.
I mean we just clearing a little room to sit out that is all and looking after our foundations at the same time.

Has the tree got a disease? if not then it should not be cut down at all ! if its only 10 feet tall then what harm is it doing? , a ten foot silver birch sappling cant block out much light and wont do damage to foundations either. I cant for one minute see why you cutting trees down will make the place tidy and nicer confused and as far as all the shite and rubbish being dumped is concerned, thats not the trees fault , cleaning the rubbish up instead would be a much better idea biggrin Please dont kill trees just because they are a minor inconveniance to your BBQ plans, trees are beautiful things and have every right to be here too. mollman, me and fee have chained ourselves to the tree, and our other comrades have taken your cat tiddles hostage(shes fine by the way). Your neighbour, you know, the grumpy one, is bringing us food and fresh water when your not looking , so you wont starve us out either(decided hunger strike was a bad idea). Weve laid an intricate trip wire system too, so breaking through our defences will be very difficult . If it worries you so much you can't sleep, drastic action is needed. Your only option is to move house, far far away from any trees.
