The trees may be protected, or they may not.
I'd get on to your local council pronto, before any more are cut.
Your neighbour probably won't be able to do anything because it isn't even his tree - I would have thought it was up to the owners of the land to complain, if anyone. As far as I'm aware (please, anyone, correct me if I'm wrong), you can cut off the offending branches as long as you give them back to the owner of the tree. So you should throw them back over the wall/fence. If it's causing problems because of the roots (lifting your flagstones) then you might be able to get the council or the owner to actually remove it. If the council come out for a look, ask them about that because of damage to your property.
get your local environmental officer to make a site vist and ask if there's a preservation order on the tree, and, make him/her aware of the damage the root system is doing to your property.

depends on area and council policy.
Legally you can cut back any branches that overhang on your property. but only as far as your property extends

You want to cut the trees DOWN to make the place nicer???? Sorry if I have misread this Mollman, but I think a small paving stone being lifted is well worth the price of having a bit of nature in what is obviously an urban landscape.
And if you say it is 10 feet tall.... exactly how harmful is that? Live with it, and appreciate the wildlife it brings into the area as well as the shade it may cast on hot days while you are having that BBQ...
I bought a 15 foot tall tree a couple of years ago, it lives in a (very large) container in my back yard. It has brought a bit of nature into the terraced, concreted street where i live, along with blackbirds and blue tits that previously hadn't been seen here.
I'm off to hug my tree now....

I'm sure the street is a nicer place for having trees in it, and they shouldnt be got rid of. Silver birch are beautiful trees too. There are not nearly enough trees around where I live apart from conifers and would love to be able to see one of those on my street.

mollman, me and fee have chained ourselves to the tree, and our other comrades have taken your cat tiddles hostage(shes fine by the way). Your neighbour, you know, the grumpy one, is bringing us food and fresh water when your not looking , so you wont starve us out either(decided hunger strike was a bad idea). Weve laid an intricate trip wire system too, so breaking through our defences will be very difficult . Please reconsider your plans for the tree and this can all end peacefully and quickly,,,,,,S.H.I.T Liberation Front :wink
