I wonder, would this have happened if you'd been in the right lane to begin with?
H.x

Quite possibly not - he was obviously in the wrong lane intending to beat someone away from the lights.
Its always about laying the blame at someone else's door.....never a case of " ok i fucked up,i put my hands up to it,i'm a stupid idiot"......but instead trying to justify their actions!
I agree, however I did not actually break any laws ! Its quite ligit to use the right hand lane, my speed was within the legal limit for that road. Had i not been there It would be a one car incident ( although it was in the mind of that driver that I was the "one to beat" but why ? After all a bike can pull away quicker than a car, my term "beating" in that sense was because I could, no need to try, or are you the type that follows bicycles even though you could safely overtake them ! ) Anyway my story was to illistrate that fixed cams can be wrong somtimes but generally its rather damming if one does get caught.
Sorry for confussion, for 'right' read 'correct'.
No I'm not the kind of driver that hangs behind a bike when I can safely overtake (although I currently drive a van so I have to be aware of the fact that I'm in a slower accelerating vehicle and also need to give a cyclist plenty of room).
My point was that you shared the same mentality as the driver in the left hand lane but can't quite seem to appreciate it.

It's a pity people don't put as much effort into keeping within the law as they do to break the law.
So you'll quite happily drive without tax and insurance, just because you got caught speeding? How pathetic!
Mal

Curious here Mal..... Do you drive at all? If so can you honestly without a doubt say you have never gone over the limit even by a little? Not ever....... I would seriously doubt if you or anyone has managed not to at some point so does that make every driver a criminal?? To me a criminal is a different breed altogether from people who make an honest mistake.... Agree about the tax and insurance thing though. If you do that it is a crime and should be delt with but its so easy to find yourself at the end of your teather with all the stupid harrassing rules that are forcing more and more to do so.
Lets face it some rely on there cars to live and support families and bad SH habits and the like!!

Just my opinion..... Mike

As with everything - I'll give a very hearty disclaimer on this - but at the end of the day it's been used increasingly, and you really have nothing to loose
However, if the Registered Keeper was driving at the time of the alleged offence, there is nothing preventing them from completing a similar witness statement.
It is advisable to write on the blank and uncompleted NIP/S172 notice only the following words: “Please see the attached” - then attach it to the following statement and return them both via Special Delivery.
WITNESS STATEMENT
(C.J. Act 1967, s9 MC Act 1980, ss. 5A (3a) and 5B. M.C. Rules 1981, r70)
Name:........................... Occupation:................
D.o.B:........................... Over 18
_____________________________________________________________________
This statement consisting of 1 page and attached NIP/ S 172 Notice is true to the best of my knowledge and belief and I make it knowing that if it is tendered in evidence I shall be liable to prosecution if I have wilfully stated in it anything which I know to be false or do not believe to be true.
Dated....................... Signed................................
_____________________________________________________________________
Their Ref: NIP reference number
Vehicle registration number
Dear Chief Constable,
Further to the above Notice of Intended Prosecution: I confirm that the following individual was driving the above vehicle at the time of the alleged motoring offence:
ALL OF THE DETAILS REQUIRED ON THE NIP – name, address, date of birth, driver number etc. etc.
As this statement is provided under threat of criminal penalty and as I have not received the caution required by paragraph 10.1 of PACE Code C 1 All E.R. 58], I make this statement on the express understanding that it shall not be used or disclosed in any proceedings of whatever nature against myself.
Yours sincerely,
Signature of driver
Name of Driver
hope this helps - let us know
kbuk

Yes, I read MCN as well, but according to the law governing the naming of the vehicle driver, you haven't named the driver in a usable form. The police are now prosecuting persons using the above form for that offence. Whether they succeed or not is awaited with interest. Even if they don't, the law is being changed as we sit at our pcs'
The REASON for the above form succeeding is that there has been no formal warning before taking a statement, a requirement of PACE. You may therefore have been sent both a NIP and another warning statement. In which case the above would be useless.
Either way, you NEED to see a solicitor specialising in criminal law....
Very Bad, good idea : invest in some false numberplates !
fairly good ish idea : buy a radar detector !
Best idea keep to the limits unless you can see the way ahead is clear !

Yes, I drive, Mike. Yes, I've been caught speeding too, when I needed my car as part of my work and yes, it would have affected my work, income and good SH habits, if I was banned. But when I got caught speeding, I cursed, paid the fine, took the points and then made sure I did my damnednest (?) to make sure I LEGALLY didn't get anymore points and ultimately a ban. In my personal case I got the speed cameras on my TomTom and try to ensure I do drive within the limits.
But when you have a situation whereby someone has admitted that should they get banned, they would commit further more serious offences, to get round the punishment, that is what I was calling 'pathetic'. How far do they go? How much might that escalate if they get caught committing these more serious offences. For them to get banned in the first place, it wouldn't be from being 'accidentally' over the limit once. Nor would it be the case of twice. Potentially not even three times, but FOUR. That is someone who is blatently not trying to stay within the limits and suffering the consequences.
So they complain it will affect their livelihood if they were banned, but how will it affect their family if they commit the more serious offences? Their partner is likely to know they have been banned and will know they are committing further offences, so they are now dragged into being complicit with the offence by knowing that they are banned and seeing them getting into the car, risking getting caught again. Think of the worry that they now have that this person is consciously getting into a car illegally. It beggars belief.
Mal
I agree with Mal,i've been stupid enough to get caught speeding and offer no excuse for it,i accept it and learn from that and never let it happen again......but to say your do something far more ilegal not to get caught in future is just beyond belief!!

I'll admit to speading on the motorway.......or thinking I was. Since I've started using a tomtom, I've found that when my speedo says I'm doing 80mph, my tomtom says I'm doing 70 mph. I've decided to believe my Tomtom.......does anyone know which one is most accurate?
The other thing I find is when on motorways you are in a lose lose situation as far as the highway code is concerened. If you stick to the speed limit then (especially when in the right hand lanes overtaking) you are disrupting the flow of traffic and breaking the highway code. If you keep up with the flow of traffic you are breaking the speed limit and therefore breaking the highway code.

Hi Les
Your Tom Tom will be the most accurate. I have discovered the same since getting one - my car speedo reads about 4-5mph faster that it actually is/than my Tom Tom, so 80mph in reality for me is about 76mph.

blimey kbuk......all of that
i normally just smile nicely........and wear a short skirt.......it works for me eerytime!

Unfortunately I don't posess the legs!
My TomTom says 70 , my speedo says 75 in my Audi.
TomTom says 70 , my VW speedo is 77.
Appears GPS system is more accurate than speedometers.
But is it not time that the UK joins the modern world and sets a higher limit for motorways - Ii am sure 85/90 is acceptable but maybe the police like catching speeders as they are easy targets ( yes I did say that )
Where I live - drug dealers deal every day but police want mister BIG ( my arse )
you do 80 and you are goosed - FACT.
i was stopped on way to work the other morning,my excuse was
im terribly sorry officer i am rushing to work at local hospital
and what do you do there that is so important you have to speed he asked
i replied im a rectum stretcher officer ,what the hells that he said.
so i explained that i strecth rectums by using my fingers then my hands and arms
until i can stretch it to nearly six feet ,
my god he exclaimed what do you do with a six foot asshole
my reply was put him a uniform and give him a speed camera .
the result 3 points fine and the look on his face priceless
