We are fucking gutted.
Just got the response from the Home Office when we asked for Reese's Visa to be extended and they have refused it.
We have 10 days to appeal or he gets deported.
I have contacted my legal helpline and they (like the CAB) just give us another number to call, which was open till 2pm, and constantly engaged, then closed.
I have emailed my MP.
If they take R away from me, not only will we be seperated and totally miserable, but my kids and me will be homeless.
We did not think we had done anything wrong.
Please, don't make this a "some people can walk into the country, not speaking English and get a house, etc etc" arguement. Just, if there is anyone here who could PM me or Reese some advice, or a contact, or just something, anything Goddamnit that might help.... PLEASE do.
I don't know what else to do.

I don't know anyting about the law on this, but surely as you're married isn't Reese considered a British citizen? :shock: :shock: :shock: :shock:

Not legal types but we did have a friend who was American but lived in the UK. To fulfil her legal commitments or regulations or whatever it was, she had to go back to the states for something like two weeks every year. Dont know what it was called or even how it would help you pair.
Surely with Reese being married to a UK citizen now, does that not change everything?

No. Being married entitled you to nowt.
He has a Visa which entitles him to stay in the UK for 6 months at a time. But every time he comes back here, it is a nastier time at Customs.
We try to do the right thing and get him an Indefinate Leave To Stay Visa and rthey refuse it. When he goes back, as this has been refused, he's possibly not gonna be let back in.

Not being funny, but as a last resort get him in a caravan in the back garden and claim he is a Traveller (ie gypsy) because as from today until a ruling from the House of Lords all illegal travellers' camps cannot be moved. Something to do with Human Rights Laws.

So weve discussed it and we reckon it works like this .........the visa has been refused because of the new attitudes in the Home Office of late to immigrants ( dont know if Reece is working but that would be a factor assesment wise) . The suits and HO have been cracking down on marriages of convenience because of the large amount of cases in the press . Basically as long as you lodge your appeal he wont be going anywhere for a very long time and during that time as long as you can demonstrate that your marriage is legal and genuine and not a sham ( easy in the case of you guys :-) ) he should be OK .
Thats what we reckon anyways . So get yer appeal in and relax for a while til you get a chance to visit the solicitors xxxx
I know a couple who did this the other way round (they moved to the US) bu they looked into living here too - I'm trying to get hold of them now...
You might get an extension to the visa while the appeal is being considered?
Another avenue is that if a buiness delares that Reese has skill they need that no British person can provide, and they hire him, then that counts very strongly in favour of a visa application.

I can offer no practical help whatsoever but just to let you know we're thinking of you both and hoping for a speedy outcome.
The only thing I can think of is to get some supporting evidence from people who have known you both (was gonna say intimately but am thinking better of that ;) ) people like your consultants, anyone in the village of a recognised profession (by that I mean like when you need your passport stamping etc).
If you need anything and you think we can help then you only need to ask.

Vix, the advice from Silk and Big G sounds like the definitive piece of advice, but if you're still in need of advice, you're welcome to let me know, I have a friend whose sister is an immigration officer, and I could phone her. She (the sister) has given me good advice on the immigration regulations before.

right... just spoken to a friends who have done law... the said speak to a solictor is specialises in immegration law.... spoken to my mum who know people in the same predicament... appeal straight away!!! from my understanding they cannot deport anyone from the country when it is under appeal.......this should then buy you both a bit of time....

Don't know if has been posted yet and I don't know if it's much help, but you never know.
From the brief look round the legal sites it looks like they're just running through the motions. Lodge an appeal and see what happens from there.
Why he's being threatened with deportation? Did they give any reasons? Visas are usually refused because he's deemed to fail to meet one of their criteria.
Does Reese have any family back in the states? If he doesn't then they have t take that into account as well IIRC. I.E. nnothing to be deported back to.
If he's been resident for 5 years or more ha can apply for naturalisation. How long has he been in the UK?
Play the dependants card to the full at any appeal as well.
With no disrespect to anyone on the site, this is a general forum, so unless we have a solicitor who specialises in immigration, the best advice has already been given, get a solicitor who is very familiar with the immigration process and let him sort it out.
