Fixed Penalty Notices

Good Evening
Can any fellow SH Members help with the following.
A friend was booked tonight parked partially on Double Yellow lines.
She had just nipped into a friends house and when she came out (less than 30 seconds later) there was two policemen by her car and one was writing out a Fixed Penalty Notice (FPN).
She answered all the usual questions and gave the correct details but on the FPN her first name is down as Collette, her name as she stated to the policeman is Janette.
It was not till she got home and read the FPN that she realised (being slightly annoyed etc).
Where does she stand with the FPN? Is it still valid even though the name is incorrect. Has she got grounds to dispute it
Any help would be greatly appreciated.

i think she might have a case...if the wrong name was written down...i think it could be invalid!
If "Janette" fails to answer the FPN then I have a feeling it will revert to the registered keeper of the vehicle..
Similar to speeding tickets...
Is there risk she can be accused of giving a false name?
I know warrents have failed because of misspelled names, but not sure about this, cos she gave the name herself.
It is a good point to remember though, it only takes a few inches of car over the yellow lines (not even a wheel) and you are seen as illegally parked.
All sympathy to her though, it's bloody annoying to get caught out over something so trivial. I got done for speeding (camera) on a road that is normally too busy to allow speeding, but it was a thursday afternoon and no traffic. mad My fault but infuriating all the same.

If you Google PNLD FAQ you can submit your question along with your email address and your question will be answered.
Its the Police National Legal Database and I know sceptics may say its the Police Database so therefore they will say the notice is enforceable but they are not allowed to give answers to questions in their own favour. The law is the law and this is what the database deals with.

Thanks for the Link helnheaven. Just had a look and there are some good questions and answers. Looks like she could challenge it but wording the question slightly differently she cannot. I will talk to her tomorrow.
To the others. Been to have a look at where she was parked and it it was in a parking bay and she said her front wheels were just outside the marked bay. Next to the marked parking bay are the yellow lines, so it was a very close call. but thanks for your input

How is she perverting the course of justice dunno
She could be accused of giving a false first name, (I presume they have her surname correct?) so it would be best to ring up and mention it. At the end of the day, her date of birth, address and car registration will all check out with DVLA.
I doubt that argument would hold much water ...
After all its not like she's a scally with a stolen car.....
Its her own car so she is easily traceable......No point in giving false names...
If she contests the ticket, the ticket may be found to be invalid by the right/wrong magistrate. The guilt is still there and the offence will go to court. After all she is not claiming it was not her. Just that the name was wrong.
Pay up, forget it!

If she WAS a scally with a stolen car, she would probably get away with it. As it is likely she is an upstanding citizen with no serious anticedents, she is more likely to be done for it.

"A parking ticket could be issued to a unattended vehicle without anyone's
name being written on it, ie the ticket is left on the windscreen of the
vehicle.
Your Christian name is not needed for the ticket and if a driver told the
Police Officer an incorrect Christian name then it would make no difference
to the validity of the ticket.
The registered keeper of the vehicle is ultimately the person responsible
for paying the fine and is the person who will be prosecuted in court if
the fine is not paid."

Tickets designed to be left on the vehicle must be left on the windscreen/vehicle (or something like that). Apparently, the old "I have started to write it now so I have to give it to you" is actually bollox. If you get in your car and drive off before it touches the windscreen, then they have failed to serve the notice. Of course you then have to prove they didn't get it onto your car (not that they would say otherwise).

I think that used to be the case but I've got a feeling that they've changed it so that now they don't have to actually put it on the windscreen, due to the fact that people had got wise to it and were driving off........I could be wrong and have dreamt that or something though...... dunno
That is still the case, a traffic warden must issue the ticket, if you drive off before the ticket is written out and applied to your windscreen its void, Thats with trafic wardens though and what i've read here is that it was the police that issued it, If you drive off when the police is issuing you a ticket them i think your in hot water as they mostly only issue tickets if your deemed to be causing an obstruction or worse rather than just a normal parking offense.

Not the most reliable of sources but I saw similar on the TV. Police saw a car parked on double yellows or bus stop went towards it and a guy flew out a shop jumped in and drove off whilst they were shouting at him. They took his number and said he would be getting it in the post. Plus it was on camera for TV lol
A FPN or ticket is just a way to keep the offence out of court. The offence of parking/obstructing can be dealt with in court if the ticket is not paid, for any reason.
A police officer may demand the driving documents of a driver, and detain said drive for the production of them. So if someone drives away without producing them (or excepts a notice to produce) they commit an offence.
Best advice! Say sorry. Say why you parked there. If you get a ticket and you think it was unjust write to the ticket office. Never ignore it.
Well as for parking tickets issued all I can say if your not causing an obstruction its just another legalised theft so fight back anyway you can..
One was Birmingham Airport Sunday night 10pm, hardly a soul around picking up sister in law etc.. (Before all the terrorist things I might add) I parked outside the terminal and ran inside to find her.. less than 5 mins later outside and a ticket on the car.. Not a single person around, the sneaky fecker! Traffic whatsit had put the time wrong by 10 mins and as I had a petrol reciept showing I had filled up now only 20 mins before in Nottm I could not have been there it was accepted.
In fact any proof you have to show you were elswhere at the time of the offence is accepted as the Government knows for a fact that up to 20% of all cars etc on the roads today are clones.. No photo of me/you with the car No pay!! Can apply to just about anything if you truly feel you were wronged!
Not saying its all legal nor even fair but then I think we pay enough to have our cars anyway.. Stuff em.
