There is a difference between civil and criminal law. If that's what you mean.
Adultery is grounds for divorce, because its one of the things cited for the dissolution of marriage (which does have several legally binding implications), and therefore in that sense it does become a legal matter, as lawyers are then employed to take it through the courts. This is the civil process that I think you mean.
You don't get arrested for adultery but you would be in contempt of court if you attempted to ignore the legal process, which then ensued following claims for divorce etc.
As I said before if either spouse wished to invoke proceedings they would have recourse to the law to do so.
Arranging a swinging party or encouraging a woman to have sex with more than one man you would be risking prosecution under prostitution laws whether or not a charge was made to attend the party.
