Hang on - this fella was in his own (albeit at a hostel) locked bedroom, doing something unusual - but not involving anyone else and he's been charged and put on the sex offenders' register???

Robert Stewart, 51, admitted a sexually aggravated breach of the peace by conducting himself in a disorderly manner and simulating sex.

For a breach of the peace to accrue the offender must have been deemed to know others where there or be reckless to them being there or be in a public place. It is possible that the offender could have told the cleaners to go away, he did not, did he engineer the situation? Did he intend to offend. That it went further than a warning suggest that there was some kind of history. Who knows? Most of us I think would have said come back later. Odd fellow anyway, look who is talking!

Anyway, it seems from the reports that he was in his own room with the door locked. Now, having had cleaning staff walk in on me when staying at hotels I don't think it's too likely that he was aware they were there. I think he was found guilty and given those punishments just because the sheriff thought he was a pervert.
As it happens, I think he is, too. Difference is I don't think the poor sap should be punished for it as he wasn't harming anyone.
